Additional Information: Clarification on Certification Requirements Related to Federal Immigration Law Compliance The Port Infrastructure Development Program (PIDP) Notice of Funding Opportunity (NOFO) includes certification requirements related to cooperation with Federal officials in the enforcement of Federal immigration law, as outlined in Section H.1.ii. Recent court injunctions in two pending cases have barred the Department of Transportation (DOT) from implementing or enforcing these conditions with respect to certain plaintiffs. To address this, the DOT provides the following clarification: To the extent that a court order bars the implementation or enforcement of one or more of the conditions related to cooperation with Federal officials in the enforcement of Federal immigration law, as referenced in Section H.1.ii of this NOFO, the DOT will not implement or enforce the relevant condition(s) against the affected applicant or recipient for as long as the court order remains in effect. Applicants who believe they may be subject to such a court order should complete their certification on the SF-424 form (Box 21) accordingly. The DOT will adhere to applicable judicial restrictions and will not enforce the relevant condition(s) against affected applicants or recipients while the court orders remain in place.
